Rules Governing Conflicts of Interest by the Employment of Trustees
No trustee of the Community College District of the County of Macomb shall engage in, or proximately cause another person to engage in, a business or governmental transaction as a representative or agent of the College or any of its divisions, departments or offices with a business entity or governmental unit in which the trustee:
- holds an executive office or position for which they are compensated, or stands to enjoy a pecuniary gain as the direct result of the transaction, or
- holds a proprietary interest unless the interest is deminimis in nature, or
- holds an elective, public office, or
- has a family member by blood or marriage who either holds a compensated executive office or position or proprietary interest (unless the interest is deminimis in nature), or stands to enjoy a pecuniary gain as the direct result of the transaction.
Whenever a matter requiring action by the Board of Trustees involves a business entity or governmental unit with which a trustee bears a relationship defined above, the trustee shall declare that relationship in writing to the other trustees and shall abstain from voting on the matter.
No trustee of the Community College District of the County of Macomb shall accept employment or engage in a business or professional activity which will require them to disclose confidential information acquired as the result of their office or position as a trustee of the College.
No trustee of the Community College District of the County of Macomb shall accept land, money, goods, services, or intangible property from a business entity or governmental unit, or a person representing a business entity or governmental unit, which is tendered in an effort to gain the favor or influence of the trustee in a matter involving the College at the time the gift is tendered or in the future, provided that this sub-section shall not preclude the acceptance of a meal or drink.
No trustee of the Community College District of the County of Macomb shall accept employment by the Community College District of the County of Macomb during the term for which the trustee was elected or appointed to office, irrespective of whether the trustee continues to hold office.
Violation of these rules shall be the subject of appropriate action by the Board of Trustees.
